The Cummins Legal function provides a full range of legal services in support of Cummins Inc. and its consolidated businesses. Our United States staff is located in Columbus and Indianapolis, IN. We also have international legal offices located in the United Kingdom, India, Australia, Brazil, China and Mexico and Africa. Through these various offices, we are able to support our businesses throughout the world.

This is an exciting Information Technology Attorney opportunity based in Indianapolis, IN,with domestic and international travel, that provides the opportunity to provide both professional legal advice and commercial guidance to Cummins Inc.’s Chief Information Office and related functions and activities which includes information technology (IT), digital technology and advanced analytics. You will serve as a trusted partner in connection with the development of products, platforms, services and other strategic technology initiatives. In this role, you will be a key interface between tech, business units and legal functions, helping to ensure quality customer experiences and compliance with global regulations.

Your impact will happen in these and other ways:

  • Manages, negotiates, drafts and oversees a variety of complex matters and leading-edge commercial and technology agreements, including privacy and data protection, information management, technology outsourcing and procurement, software licensing, cloud service providers and data/services hosted by third parties, software development, and data and analytics.

  • Reviews, drafts, negotiates and provide business-focused legal advice with respect to digital and other types of technology transactions.

  • Counsels, provides legal advice and support and manages client groups by providing practical recommendations on day-to-day legal issues, enabling the client to meet its business objectives consistent with the Company's risk tolerance.

  • Reviews and drafts a variety of agreements and documents and continuously seeks ways to improve the forms, processes, or systems involved, and advises on routine policy and procedural improvements, consulting the business on issues related to technology, and providing practical advice in response to rapidly changing conditions.

  • Identifies legal risks and designs strategies and plans to mitigate and prevent legal risks.

  • Provides legal advice when necessary to respond to data security or cybersecurity incidents or a government inquiry from government authorities.

  • Acts as an organizational leader in information technology, commercial and other corporate law matters and combines knowledge of these legal specialties with sound business acumen and knowledge of the business goals and objectives.

  • Conducts project and legal matter management independently; consistently exercises sound independent judgment.

  • Identifies and drives development of legal strategies for the Company; manages client expectations to balance requirements and competing priorities; provides useful legal advice and alternative solutions.

  • Manages a slate of domestic and international legal firms dedicated to partnering with the company to deliver value-driven legal support for the company’s strategic objectives.

  • Requires strong organizational skills, the ability to manage multiple high-priority projects simultaneously and a willingness to be flexible in a fast-paced environment.

  • Acts as trusted advisor for the IT function and other business and functional teams and management; has strong grasp of business environment and the industry; effectively partners with stakeholders to identify and design needed improvements; provides legal as well as practical advice within the appropriate business context; understands and manages client expectations; influence colleagues’ actions to mitigate risks.

  • Identify legal risks and execute strategies to advance the Company’s IT objectives and mitigation plans by understanding legal issues and translating them into easily understood and practical legal advice as well as legal advice on routine issues impacting the business

  • Responsibility for managing, negotiating, drafting and overseeing a variety of complex matters and leading-edge commercial and technology agreements including reviewing, drafting, negotiating and providing business-focused legal advice with respect to digital and technology transactions (SaaS, software license, and software/application development agreements among others); and establishing, reviewing and updating digital and technology policies and agreement forms

  • Providing legal advice when necessary to respond to a data security or cybersecurity incidents or a government inquiry from government authorities including the Federal Trade Commission, State Attorneys General, or foreign government authorities at the direction of the General Counsel and senior leadership

  • Assigning and managing work performed by outside counsel in a cost-effective manner

  • General business counseling

Qualifications

Required Education and Experience

  • Juris Doctor degree from an ABA accredited Law School

  • 7 years of relevant experience in a top tier law firm or mixture of relevant experience in top-tier law firm, corporate legal department setting, and/or government agency

  • Demonstrated experience in data privacy law such as GDPR and the CCPA

  • Experience with information security governance and technology issues and cybersecurity standards, frameworks, assessments

  • Active state bar member in good standing of at least one U.S. jurisdiction

Preferred Education and Experience

  • Career track of progressive, documented accomplishments with broad diversity of experiences

  • Experience negotiating against technology companies.

  • Demonstrated experience in intellectual property law

  • Technology and cybersecurity certifications such as NIST and SOC

  • Experience working in international settings and functioning in diverse cultures

SOC = SOC stands for “system and organization controls,” and the controls are a series of standards designed to help measure how well a given service organization conducts and regulates its information. SOC 2 is designed for service providers storing customer data in the cloud.

Compensation and Benefits

Base annual salary commensurate with experience plus annual variable compensation.
